The rise of the "gig economy" has fundamentally challenged traditional labour laws. In many jurisdictions, the legal distinction between an "employee" and an "independent contractor" has become a battleground for rights and responsibilities. While companies argue that this flexibility allows for greater efficiency and autonomy, labour unions argue that it is merely a way to circumvent minimum wage laws, sick pay, and pension contributions.
As digital platforms become the primary employers for millions, the concept of a "workplace" is dissolving. This lack of a physical site makes collective bargaining significantly more difficult. If workers are isolated, they lose the power to negotiate as a unit. Consequently, we are seeing a shift in how legal frameworks must be designed: should they protect the individual or the collective? The tension between flexibility and security remains the defining challenge of modern employment law.
